Terms of Use
Version 1.3 · Effective 7 October 2026 · Last updated 7 October 2026
These terms (the “Agreement”) are between you and DQCLabs (“we”, “us”), the publisher of the Cozy Kalimba mobile app for Android and iOS and of the website cozy-kalimba.web.app — together, “the app”. By downloading or using the app you accept this Agreement. If you do not accept it, please do not use the app.
The short version. Cozy Kalimba is free to download and play. The free version shows ads; some songs, scenes and extras are part of Cozy Premium, an optional one-time lifetime purchase that also removes every ad and has no recurring charge. You can open a premium song for 24 hours by watching a rewarded ad instead. Purchases are made through the App Store or Google Play. Your progress stays on your device. Anything you play is yours; you may not resell the app or extract its sound samples as a sample pack. Please look after your ears.
1. Who may use Cozy Kalimba
You must be at least 13 years old to agree to this Agreement on your own behalf. If you are under 13 — or under 16 in the EEA and the UK — a parent or guardian must agree to it for you and is responsible for your use of the app.
The app has no chat, no user-generated content and no accounts. It is not directed at children: the free version shows advertising served by Google AdMob (see section 9), and purchases require a store account, which Apple and Google only give to adults or to children under a parent’s family-sharing controls. A parent who lets a child use the app is responsible for that use and for any purchase made with their account.
2. The licence we grant you
We grant you a personal, worldwide, revocable, non-exclusive, non-transferable licence to install and use one copy of Cozy Kalimba on devices you own or control, for your own non-commercial enjoyment, subject to this Agreement and to the rules of the store you obtained it from.
We keep every right not expressly granted. This is a licence to use the app, not a sale of it.
3. Acceptable use
You agree not to:
- copy, sell, rent, lease, sublicense or otherwise distribute the app, or make it available on any other store or download site;
- reverse engineer, decompile or disassemble the app, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law;
- extract the bundled audio samples in order to redistribute them as a sample pack, sound library or instrument, or to build a competing instrument from them (see section 5 for what you may do);
- remove, obscure or alter any copyright, licence or attribution notice, including the licence screen inside the app;
- use the app for any unlawful purpose, or in a way that infringes anyone’s rights;
- interfere with the app’s operation or attempt to circumvent any limitation in it — including the Premium access check, the 24-hour limit on an ad-unlocked song (for example by changing your device clock), or by modifying the app to unlock premium content or remove ads without a valid entitlement;
- generate fake ad impressions or clicks, or use automated means to interact with ads in the app.
4. Music you make with it
Anything you play is yours. We claim no rights in the performances, recordings or videos you make using Cozy Kalimba, and you do not owe us a fee, a credit or a licence for them.
You may record the app’s output and publish it — a video, a stream, a track, a podcast bed — commercially or otherwise. A credit is welcome and never required.
What you may not do is redistribute the samples as samples: a recording of you playing a melody is yours, while a pack of isolated tine hits lifted from the app is not something this licence permits. If you want raw kalimba samples, the underlying FreePats bank is public domain and free for you to take directly — see the next section.
You remain responsible for the rights in any melody you choose to play and publish. A song being available to learn inside the app does not grant you a licence to record and release someone else’s composition.
5. The songs and samples we bundle
The instrument samples come from the FreePats kalimba bank, released under CC0 1.0 Universal (public domain dedication). The full licence text and its provenance ship inside the app, on a licence screen you can read at any time. Nothing in this Agreement restricts what you may do with those samples if you obtain them from their original source.
The bundled melodies are each either in the public domain — traditional folk songs, hymn tunes and classical works whose composers died long enough ago for the copyright to have expired — or original compositions written for Cozy Kalimba, © 2026 DQCLabs. Every song in the app carries its own licence note, shown in the app on the song’s page and on the licences screen. Whether a song is free or part of Cozy Premium is a product decision about the app, not a statement about the melody’s copyright: a public-domain melody remains public domain even when our arrangement of it is a premium song.
We do not bundle music we are not entitled to bundle. If you believe a melody in the app is not free to distribute, tell us at the address in section 22 and we will investigate and, if needed, remove it.
6. Our intellectual property
The app’s name, logo, artwork, illustrations, interface design, original compositions, arrangements and code are owned by us or our licensors and are protected by copyright and other laws. This Agreement gives you no right to use our name or branding except to refer to the app accurately.
7. Your device and your data
Cozy Kalimba has no accounts. Your settings, favourites, progress, practice history and recorded takes are stored on your device and nowhere else. We have no copy and no ability to recover them.
That means: if you uninstall the app, reset your device, clear the app’s storage or lose the device, that data is gone, and we cannot restore it. Nothing syncs between your devices. The one exception is your Premium purchase: it belongs to your App Store or Google Play account, not to the device, and can be restored on a new device (see section 10). A song opened with a rewarded ad is not a purchase and is not restored.
Some data does leave your device: anonymous diagnostics and crash reports (which you can turn off in Settings → Privacy), the information Google AdMob uses to serve ads in the free version, and the purchase information needed to check your Premium entitlement. How the app handles data is described in full in our Privacy Policy, which forms part of this Agreement.
8. Safe listening and sensible use
Please protect your hearing. Listening at a high volume, particularly through headphones and particularly for a long time, can cause permanent hearing damage. Set the volume to a comfortable level before you put headphones on, keep it low enough that you can still hear someone speaking to you, and take breaks.
Cozy Kalimba is a musical toy and a place to relax. It is not a medical device and not a treatment. It is not designed or tested to diagnose, treat, cure or prevent anxiety, insomnia, tinnitus or any other condition, and no claim in the app or on this site should be read as a health claim. If you have a health concern, speak to a qualified professional.
Use common sense about where you play: do not use the app while driving, cycling, or doing anything else that needs your attention, and be aware that headphones make you less aware of what is around you.
If sound, flashing or moving visuals affect you — for example if you are photosensitive — note that the app has settings to reduce background animation and motion, and can be played silently.
9. The free version and advertising
Cozy Kalimba is free to download. The free version includes the instrument, a selection of songs and lessons, Zen scenes and the rest of the app, and it is paid for by advertising.
- Who serves the ads. Ads are served by Google AdMob. We do not choose individual ads and are not responsible for the content of third-party advertisements or for any product or site an ad leads to. Your dealings with an advertiser are between you and that advertiser.
- Where they appear. Ads may appear as cards within lists, as a full-screen ad after you finish a lesson, and when you return to the app. We do not show ads while you are playing the instrument, in a Zen session or during a practice session.
- Consent and personalisation. Where the law requires it — for example in the EEA, the UK, Switzerland and some US states — the app asks for your consent through Google’s consent form before any ad is requested, and you can change your choice at any time in Settings → Ad Privacy. On iOS, the app asks permission before using your advertising identifier; declining still shows ads, but they are not personalised. Details are in the Privacy Policy.
- Rewarded ads. On a premium song you may choose to watch a short rewarded ad instead of buying Premium. Watching it to the end opens that one song on that device for 24 hours. The unlock is a free, temporary courtesy: it has no monetary value, cannot be transferred or restored, and is lost if the ad is closed early, does not load, or the app’s data is cleared. Progress you make on the song while it is open is kept. Whether a rewarded ad is available at a given moment depends on Google’s ad inventory and on your consent choices, and we do not guarantee one will be.
- Premium users see no ads. While Cozy Premium is active, the app shows no advertising of any kind.
10. Cozy Premium purchases
Cozy Premium is an optional one-time lifetime purchase. It unlocks every song marked premium and its lessons, premium Zen ambience scenes and premium collectibles, and removes all advertising from the app. The exact list of what is free and what is premium is shown in the app on the Cozy Premium screen and may change as content is added (see section 11).
- One-time purchase. The only paid plan is the Lifetime unlock, a non-consumable in-app purchase paid once. It is not a subscription: there is no automatic renewal, recurring charge or subscription to cancel. The price and included features are shown on the Cozy Premium screen before you confirm. The purchase does not have a scheduled expiry; app availability is described in section 11.
- Payment. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Your payment is taken by Apple or Google under their terms; we never see or receive your payment details. Prices are shown in your local currency and include any tax the store collects.
- Refunds. Refund eligibility depends on the store's refund policy and applicable law. For App Store purchases, request a refund from Apple at reportaproblem.apple.com, and for Google Play purchases, follow Google Play's refund instructions. You can also contact us for help with a Google Play purchase or refund. Where a statutory right of withdrawal applies to you, it is unaffected by this paragraph.
- Restoring purchases. A Premium purchase is tied to your store account. Use Restore Purchases in Settings or on the Cozy Premium screen to restore it after reinstalling or on a new device on the same store platform signed in to the same account. Purchases do not transfer between the App Store and Google Play. A refunded or revoked purchase may no longer grant Premium.
- Price changes. The price of a new lifetime purchase may change; an existing lifetime owner is not charged again for that purchase.
- Family Sharing. Whether a purchase can be shared with family members is determined by the store’s settings for the product at the time of purchase.
11. Availability, updates and changes
We may add, change or remove features, songs, sounds or scenes, and may move content between the free version and Cozy Premium; require you to install an update to keep using the app; or stop distributing and supporting it altogether. We do not promise the app, or any particular piece of content, will remain available indefinitely. We will not remove the core of what Cozy Premium offers — premium content and an ad-free app — from your valid Premium entitlement while the app remains available.
The instrument works offline. Ads, purchases and Restore Purchases need an internet connection. If we discontinue the app, we will stop selling new Premium purchases.
We may change this Agreement. If a change is material we will bring it to your attention in the app or on this site before it takes effect, and continuing to use the app after that date means you accept it. If you do not, stop using the app and uninstall it.
12. Third-party services
The app relies on the following third-party services, each governed by its provider’s own terms and privacy policy, which we do not control:
- Apple App Store and Google Play — distribution, payment, purchase restoration and refunds;
- RevenueCat — checks whether your Premium entitlement is active and restores it;
- Google AdMob and Google’s User Messaging Platform — serving ads in the free version and collecting ad consent where the law requires it;
- Google Firebase Analytics and Crashlytics — anonymous usage and crash reports, which you can switch off in Settings → Privacy.
What each of them receives is described in the Privacy Policy. This website loads its fonts from Google Fonts. If a third-party service is unavailable, the parts of the app that depend on it — ads, purchases, restores — may not work for that time.
13. Copyright and other complaints
If you believe something in the app infringes your rights, email us at the address in section 22 with enough detail to identify the material and your claim. We take it seriously and will remove infringing content promptly once verified.
14. Suspension and termination
You may end this Agreement at any time by uninstalling the app. We may end it, and your licence with it, if you materially breach it — for example by tampering with the app to unlock Cozy Premium or by committing ad fraud. Uninstalling the app does not refund your one-time Premium purchase or remove it from your store account. Restoration is described in section 10.
Sections that by their nature should survive termination do: intellectual property, disclaimers, limitation of liability, indemnity and governing law.
15. Disclaimer
To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, free of harmful components, compatible with every device or operating system version, or that it will meet your expectations — musical or otherwise. Audio latency, in particular, depends on your device, its operating system and any Bluetooth accessory you use, and is outside our control.
Nothing here excludes a warranty or right that cannot be excluded under the law that applies to you as a consumer.
16. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or opportunity, arising out of or connected with your use of the app, even if we have been advised of the possibility.
Our total aggregate liability arising out of or connected with this Agreement is limited to the greater of (a) the amount you paid for Cozy Premium in the twelve months before the claim and (b) USD 50.
Nothing in this Agreement limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
17. Indemnity
You agree to indemnify us against claims, damages, losses and reasonable costs arising from your breach of this Agreement, your misuse of the app, or your infringement of someone else’s rights — including in music you record with the app and publish.
18. Governing law and disputes
This Agreement is governed by the laws of Viet Nam, without regard to its conflict-of-laws rules, and the courts of Viet Nam have jurisdiction over any dispute.
If you are a consumer resident in the EEA, the UK or another jurisdiction whose law gives you the right to bring proceedings in your own courts and under your own consumer law, this section does not take that right away.
Please email us before starting anything formal. Most things are a misunderstanding and are quicker to fix directly.
19. Apple App Store terms
Where you obtained the app from the Apple App Store, the following applies and prevails over anything inconsistent above:
- This Agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for Cozy Kalimba and its content.
- Your licence is limited to using the app on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Cozy Kalimba.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app — including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation, including in connection with the app’s use of the HealthKit or HomeKit frameworks (Cozy Kalimba uses neither).
- We, not Apple, are responsible for investigating and resolving any third-party claim that the app or your use of it infringes that party’s intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, will have the right to enforce it against you.
20. Google Play terms
Where you obtained the app from Google Play, this Agreement is between you and us only. Google is not a party to it and is not responsible for Cozy Kalimba. The Google Play Terms of Service apply to your download and to any purchase made there, and Google’s refund policy governs any refund.
21. General
- Entire agreement. This Agreement and the Privacy Policy are the whole agreement between us about Cozy Kalimba and replace anything said before.
- Severability. If a provision is held unenforceable, the rest stays in force and that provision is read down to the minimum extent needed.
- No waiver. Not enforcing a right straight away is not a waiver of it.
- Assignment. You may not assign this Agreement. We may assign it as part of a merger, acquisition or sale of assets, on notice to you.
- Standard EULA. This Agreement is the end-user licence agreement for Cozy Kalimba. Where you obtained the app from the Apple App Store and this Agreement is silent on a matter, Apple’s Licensed Application End User License Agreement applies to it.
- Notices. We give notice in the app or on this site. You give notice by emailing us at the address below.
- Language. This Agreement is written in English. Any translation is provided for convenience only; the English text prevails.
